This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between brainslab LLP (hereinafter referred to as the "Administration"), the owner of the website located on the Internet at https://brainslab.host (hereinafter referred to as the "Site"), and any individual or legal entity using the Site (hereinafter referred to as the "User").
1. Terms and Definitions
1.1. Site – A collection of software and hardware for computers that ensures the publication for public viewing of information and data, united by a common purpose, through technical means used for communication between computers on the Internet. The Site is located at https://brainslab.host .
1.2. Site Administration – brainslab LLP , which owns all relevant property rights to the Site and carries out its administration.
1.3. User – Any person accessing the Site via the Internet.
1.4. Services – Services for outsourced development of software, web applications, mobile applications, and other IT services, information about which is presented on the Site.
1.5. Request – A User's inquiry to receive a consultation or a commercial offer for the Services, sent through the feedback form on the Site.
2. Subject of the Agreement
2.1. This Agreement is a public offer. By accessing the materials of the Site, the User is deemed to have accepted this Agreement.
2.2. The Administration provides the User with access to the use of the Site and its functionality, including the ability to review information about the Services and submit a Request.
2.3. The use of the Site's materials and functions is governed by the norms of current legislation.
3. Rights and Obligations of the Parties
3.1. Rights and Obligations of the User:
3.1.1. The User agrees to use the Site solely for purposes that do not contradict this Agreement and current legislation.
3.1.2. The User agrees to provide accurate information (name, email address) when filling out the Request form on the Site.
3.1.3. The User is prohibited from using the Site to distribute spam, malware, or to perform actions aimed at disrupting the normal functioning of the Site.
3.1.4. The User has the right to receive information about the Administration's Services by studying the materials on the Site and submitting a Request.
3.2. Rights and Obligations of the Administration:
3.2.1. The Administration undertakes to ensure the functioning of the Site, except during periods of maintenance or force majeure events.
3.2.2. The Administration has the right to unilaterally change the content of the Site, information about the Services, and the terms of this Agreement at any time. The new version of the Agreement comes into force from the moment of its publication on the Site.
3.2.3. The Administration has the right to send the User responses to their Requests and other information related to the provision of Services to the email address provided by the User.
4. Intellectual Property
4.1. All objects posted on the Site, including design elements, text, and graphic images, are objects of the exclusive rights of the Administration.
4.2. Copying, distributing, or otherwise using the materials of the Site without the prior written consent of the Administration is not permitted.
5. Limitation of Liability
5.1. The Administration is not liable for any losses that the User may incur as a result of using or being unable to use the Site.
5.2. The information about the Services on the Site is for informational purposes only and does not constitute a public offer. The specific terms of service provision are negotiated individually.
6. Final Provisions
6.1. All possible disputes arising from or related to this Agreement shall be resolved in accordance with applicable law.
